Some parties will request that all written materials, documents and other things made available for the purpose of the CDA be returned. In this case the receiving party is entitled to retain one copy of the material to determine its obligation under the agreement. Other sections may pertain to further rights and obligations, the former indicating that there is no implied license. This makes it clear that by signing the CDA that there are no obligations beyond providing confidential information. No further obligation means that there is no obligation to negotiate or enter in a licensing agreement. Types of Agreements There are several common types of "technology transfer" mechanisms available to the academic researcher. These include consulting, sponsored research, materials transfer, licenses and participation in consortia. When entering into negotiations for one of these agreements, it is usually preferable to address the non-financial issues first. Defining the scope of research and the non-financial terms first will help to assign the value of the agreement. These non-financial issues include confidentiality concerns, publication rights, ownership of data, performance of research and rights to improvements, as well as the more legal concerns of indemnification and warranty. Once these terms have been negotiated it is appropriate to address, as applicable, dollar amounts assigned to license fees, IP costs and research funding. The goal of the agreement negotiation for both parties is a win-win situation. The first step should be to determine what the other party needs and wants to achieve from the collaboration or deal, and try to accommodate these needs. In many instances money is not the key, and creativity in deal structure can help to get both parties what they need. These scientists worked within a philosophy of biology outlined by Immanuel Kant 1724-1804 ; . In his Critique of Judgement published in 1790, Kant argues that the concept of cause and effect can and should be used when studying events that take place in the inorganic world, as consequences tend to follow one another in a linear sequence. Problems arise when applying this view to the organic world as cause and effect are linked. A tree causes leaves to grow on it yet the leaves also cause the tree to grow; in Kant's words, "An organised natural product is one in which every part is reciprocally both ends and means".9 In order to escape this paradox, he suggests that when studying events in nature one must assume that natural phenomena have an innate purposefulness. This assumption however, must remain just that, an assumption to help guide enquiry, and one must be careful not to make the logically inconsistent leap that nature really is purposeful. Coverage of Non-Sedating Antihistamines Brand non-sedating antihistamine drugs are paid as Tier 3, regardless of the drug's formulary status of preferred or non-preferred drug. For example, if you prefer to take the medication Clarinex rather than buying Claritin over the counter, you will pay the Tier 3 copayment. Retail Refill Limit The Prescription Drug Program will maintain a Retail Refill Limit policy. The retail refill limit requires that you use the mail-order pharmacy if you are prescribed a maintenance medication, rather than refilling multiple prescriptions for the same drug at a retail pharmacy. If you or a covered dependent receives a prescription for a maintenance medication and you do not use the mailorder pharmacy, your prescriptions may not be covered. In some circumstances, you may not be required to use the mail-order pharmacy. For example, there are several categories of medications that are uniquely appropriate for multiple refills at your local pharmacy and are therefore exempt from the mandatory mail-order provision, as outlined above ; . The proposed TMDL was developed using Monte Carlo Simulation to determine long-term average concentrations that each stream segment could accept and still meet water quality criteria 99% of the time. Monte Carlo Simulation allows for the expansion of a data set based on its statistical makeup. Since there was no critical flow condition where criteria were exceeded, the Department used the average flow to express the loading values in the proposed TMDL. The proposed TMDL for the Laurel Run Watershed sets allowable loading rates for metals and acidity at specified points in the watershed. Field data was used to establish the proposed TMDL for the Laurel Run Watershed. The data and all supporting information used to develop the proposed TMDL are available from the Department. The Department will accept written comments on the proposed TMDL for the Laurel Run Watershed. All written comments must be postmarked by March 21, 2007, and sent to Scott Barnes, P.
